One of my practice models has joined a modeling agency and when she applied she used some of my photos of her. Her mums mobile kept dropping out. Anyway in the conversation she informed me that the modeling agency has used some of my photos on their website for her portfolio. If this is true and I need to again clearly clarify this. I am really pissed as these are my photos no copyright has been handed over. Has anyone had business dealings with modeling agencies and I would have thought that they would have their own photographers to do her portfolio building. What ever happened to professionalism and respect of copyright.

You do own the rights to the images Nina, so I assume you could ask them to be removed. it's all down to a clear uderstanding when you shot the images in the first place though. What was the understanding between you and the practice model? Did you give her rights to use them? I assume she posed for free in return for you to practice?
I would put it down to experience and let it be.
I forgot to click the option to prevent the right click copy on a slide show i did recently for a pre-wedding shoot the other day. I have the weddig to shoot for the couple next month. The agreement was they buy the CD or buy prints if they like the images from the shoot..but I now suspect they have just saved them from the online gallery, one has even been used as the guy's avatar on face book!
What can I do? Nothing
We all have to be carefull if we value our work..learn from it and put things in place to prevent this happening again

It has always been very clear that those photos are still my photos and we have worked together before. The sole purpose of the photos were for her mums wholesale clothing website and that is what I agreed for them to be used for. In exchange and has been done before, my name and website are under the photos. One of my other practice models has joined up with the same agency. I seriously need a cut for finding them talent. I will ask her mum tomorrow at school what is happening with the photos I did for her over time and have they asked to use them.
I agree live and learn. Re facebook I noticed a while ago that some togs in the packages offer facebook sizes of their photos for families to share.

it does look like the model or models have over steped the agreement. ( did you have it in writing what they could use the images for?Other than getting all leagal about it I have no idea what you can do?
The facebook thing is fine with me, if they had actually paid for the images in the first place, but a right click copy is just simply stealing an image.

it won't happen again though.

Nina are the pics on the agency site being accredited to you or passed off as the agencies?
Rich even tho you left them clickable do you not have a disclaimer on there to say the copyright is yours?

It was my mistake for preventig the right click as I was rushing to get stuff done before I went to Scotland. The problem I have is I still need to work with the couple on the wedding day so I can't kick up a fuss. It my mistake and I can cope with the loss, I don't trust anyone to do the right thing so it's no big shock anyway.
They are my pics with or without a disclaimer.

I am going to get the website tomorrow Jayne and have a look. Even if they are accredited to me wouldn't a phone call email to check would be standard practice. Expecting too much again
Rich suggestion a big yellow sticky note on screen click yes to no right click option.

I hope this has not felt like I hi-jacked your thread Nina, far from it, I'm just showing another example of copyright problems we all seem to have to deal with. It's quite clear people will take advantage of any loopholes we leave open.

either they have your logo or copyright logo on each image or the website should give you full acknoldgement. Unless of course a model release form stating the model could use them as she wished?

I spoke with the model and made it clear of what I expect. Kenny did make a valid point that I should get it in writing. I am not handing over the disk of shoot on sunday until she signs a agreement with me.
